Scope
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions made through the online shop www.theepicuriste.ch (hereinafter referred to as “we,” “us,” “our,” and “Site”). This online shop is operated legally by Contactit SA (hereinafter referred to as “we,” “us,” and “our”).
These GTC apply to all users of the Site (hereinafter referred to as “you”), including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these GTC carefully before accessing or using our website. By accessing or using our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following GTC, including any additional terms, conditions, and policies referenced herein and/or available by hyperlink.
The version of the GTC that is applicable at the time of your order is decisive and cannot be unilaterally changed for that order. Any of your terms and conditions that conflict with or deviate from these GTC are not recognized unless we explicitly agree to them in writing.
Contract Conclusion
The products and prices listed on the Site constitute an offer. However, this offer is subject to the possibility of delivery issues or incorrect pricing (whether by us or the manufacturers). This means that we may be unable to deliver products due to unavailability or inaccuracies in pricing.
Offers are valid as long as the product is available in the online shop and/or while supplies last. You will be notified if a product is no longer available at the time you place your order. We reserve the right to change or discontinue products at any time without prior notice. Changes will not affect orders that have already been confirmed.
By placing an order through the Site, you submit an offer to purchase the selected products. You will receive an automatically generated order confirmation email to acknowledge receipt of your order. Please note that this confirmation does not guarantee product availability or delivery; it simply confirms that your order has been received and that a contract has been formed, contingent upon availability.
If any of the conditions mentioned occur (such as non-delivery or incorrect pricing), the contract will be dissolved immediately without further action required from either party. We will inform you promptly about the dissolution. If the product has already been delivered, ownership will revert to us, and you must return the product (with a refund of the price you paid). If the product has not been delivered, you are under no obligation to accept it. We will make efforts to provide a replacement delivery, but we are not obligated to do so.
All communication regarding your order and the contract conclusion will be done via email. It is your responsibility to provide an accurate email address and to monitor it for important notifications.
Product Information
Information about products, recommendations, warranties, and warranty durations is sourced from the manufacturers of the products sold on the Site. This information is provided without guarantee and should not be considered a promise. We do not guarantee the accuracy, completeness, or timeliness of this information and accept no liability for any discrepancies.
Product images displayed on our social media, in printed materials, and on the Site are for illustrative purposes only and are not binding. While we strive to represent the colors and images of our products as accurately as possible, we cannot guarantee that the colors shown on your device will be accurate.
Many of the products offered come from brands outside Switzerland. As a result, there may be delays in delivery due to production or delivery issues, or inaccurate inventory data. All information regarding delivery times is non-binding and subject to change at any time without notice. If a product can no longer be manufactured or supplied, delivery may be impossible, as outlined in the relevant terms.
We are also not liable for advertised products sold on other platforms linked to our online shop, as the terms and conditions of those shops will apply.
Pricing
The sales prices displayed in the online shop are listed in Swiss francs (CHF). These prices include value-added tax, as well as any applicable shipping costs according to our shipping conditions. Prices for our products may change without prior notice. The price in the online shop at the time of your order is the one that applies to the sales contract, except for conditions outlined in the "Contract Conclusion" section of the GTC.
Payment Terms
You agree to use the payment options available on the Site. These options are displayed during the checkout process. Currently, we accept several payment methods, including Twint, American Express, Apple Pay, Google Pay, MasterCard, Maestro, UnionPay, Shop Pay, and Visa. For all our payment options, the charge will occur at the time of the order.
Cancellation and Termination of Contract
Orders are binding as outlined in the "Conclusion of Contract" section of these GTC. You are required to accept the ordered products. While changes and cancellations may be possible in certain situations, they are at our discretion and could incur handling fees, which will be charged to you.
We reserve the right to refuse any order placed with us. We may limit or cancel quantities purchased by an individual, household, or order at our discretion. These restrictions can apply to orders made under the same customer account, credit card, and/or those using the same billing or shipping address. If we make changes to or cancel an order, we will attempt to notify you using the email and/or billing address or phone number provided at the time of the order. Additionally, we reserve the right to restrict or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.
Delivery and Shipping
The offer of products in our online shop is exclusively directed at customers with a residence or registered office in Switzerland or Liechtenstein. Deliveries are made only to addresses in Switzerland or Liechtenstein unless another delivery address is agreed upon individually.
Returns and Exchanges
We accept returns on eligible full-priced items within fourteen (14) days from the date that the item was delivered to you. To be eligible for a refund, items must be returned unopened/unused, with tags, in their original packaging. Furthermore, we cannot accept responsibility for lost or delayed returns. Responsibility passes to us once the return reaches our warehouse.

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 (ten) business days. Refunds do not include any shipping costs.
Any item returned to us after 14 (fourteen) days of its original delivery date is not eligible for a refund.
Please note that due to hygiene reasons we do not accept returns of opened personal care items (perfumes, fur care, etc.). We also do not accept returns of items marked as "sale", gift cards, or any items specifically marked as non-returnable on the product’s page, unless you receive an incorrect or damaged item. If you’ve received an incorrect or damaged item, please contact us directly at support@theepicuriste.com with photos and a description of the issue.
We do not accept exchanges, as items may sell out while the requested exchange is returned and processed. We encourage you to return the original item and place a new order for the correct item.
Warranty and Liability
There is a two-year warranty period starting from the date of delivery, with the invoice receipt serving as the warranty certificate. In the event of a warranty claim, manufacturers usually offer a repair, a replacement with an equivalent product, or a reimbursement based on the item's current value, not exceeding the original purchase price. The decision regarding the warranty claim lies solely with the manufacturer.
If the manufacturer's warranty exceeds the one we provide, you must contact the manufacturer directly, as we do not manufacture the products sold on the Site. Warranty claims are granted exclusively by the manufacturer, and the evaluation of such claims is entirely their responsibility.
A warranty service can only be offered if there are no exclusions, such as damages caused by improper handling or mechanical issues. This includes elemental damages, moisture damage, fall and impact damage, excessive wear, and defects resulting from modifications. Wear parts, and similar items are excluded from the warranty or have a reduced warranty period.
If the manufacturer or service partner incurs costs for repairs outside of the warranty, these costs will be charged to you. For products that do not exhibit identifiable faults or where the defect is not covered by the manufacturer's warranty, we or the manufacturer may pass on the costs for assessment and shipping to you.
A warranty exchange or repair does not extend the original warranty period. Additionally, the statutory warranty provisions under Articles 197 et seq. of the Swiss Code of Obligations (OR) apply. You are entitled to rectification but not to rescission or reduction.
Redemption of Discount Codes
We may issue discount codes from time to time. These discount codes may require a minimum order value. Discount codes typically cannot be combined, meaning that only one discount code can be redeemed per purchase. Value vouchers that are not fully redeemed do not entitle the holder to a refund of the difference, and the remaining amount is forfeited.
Terms and Conditions for Contests
Any natural person who has reached the age of 18 is eligible to participate in contests organized by us. Only one entry per person is allowed. We reserve the right to delete abusive entries.
Winners will be notified via email or social media and may be published. Contest participants agree that submitted images, videos, or texts may be published by us and our partners. Correspondence regarding the competition is permitted. Cash payments and legal recourse are excluded. The information provided by participants must be complete and truthful. Participation is free of charge and entails no purchase obligation. Participants agree to the evaluation of their data by us for marketing purposes.
Liability
Claims for damages related to non-delivery, contract termination, breach of contract, poor performance due to negligence at the time of contract conclusion, and unlawful acts are completely excluded unless there is intentional or grossly negligent conduct.
Please note that we are not liable for indirect damages, consequential damages, or loss of profits resulting from the use, malfunction, or failure of the goods we deliver.

Your submission of personal information through the store is governed by our Privacy Policy.
Governing Law and Jurisdiction
These GTC and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Canton of Vaud, Switzerland.
Changes to the General Terms and Conditions
You can review the most current version of the GTC at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of GTC by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these GTC constitutes acceptance of those changes.
Severability
In the event that any provision of these GTC is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these GTC, such determination shall not affect the validity and enforceability of any other remaining provisions.
